Why Are Blowback Handguns Showing Up on Colorado's SB25-003 List?

One of the biggest surprises in Colorado’s draft SB25-003 firearm guidance is the appearance of several handguns that many shooters would never casually describe as “gas-operated.”
Examples in the Department of Revenue’s draft guidance include the HK VP70, Hi-Point pistol and carbine platforms, and the Walther CCP, among many others. The draft itself also notes that the photographs are examples only and do not represent every firearm covered by the law.
So why would these firearms appear on the list?
The answer may lie in the wording of SB25-003 itself.
In traditional firearms terminology, “gas-operated” usually refers to firearms that use a dedicated gas system—such as direct impingement or a gas piston—to cycle the action. Most shooters would not use that term to describe a simple blowback firearm.
However, SB25-003 creates its own statutory definition. Rather than relying solely on traditional gas systems, the law also includes a blowback-operated system that “directly utilizes the expanding gases of the ignited propellant powder acting on the cartridge case to drive the breechblock or breech bolt rearward.” Because of that language, Colorado appears to be using a broader legal definition than the one commonly used in the firearms industry.
That broader definition may explain why firearms that many owners consider blowback-operated are appearing in the Department of Revenue’s draft guidance.
This does not necessarily mean every blowback firearm is regulated, nor does the draft list represent every firearm covered by the statute. The Department of Revenue states that the list is guidance and will continue to evolve. Ultimately, the controlling authority remains the statutory language itself, along with any future agency guidance or court interpretation.
BOTTOM LINE: SB25-003 uses legal definitions that don’t always match the terminology familiar to industry standard & shooters. If you’re relying only on traditional firearms vocabulary, some of the firearms included in Colorado’s draft guidance may come as a surprise.
