The 9th Circuit must reconsider the case in light of the recent high court decision on High Capacity Magazine Ban.
The U.S. Supreme Court on Thursday vacated a ruling on the Californian gun magazines ban that hold more than 10 rounds. By sending the gun case back to lower courts, the SCOTUS gives them the opportunity to apply a newer court guidance. The SCOTUS ordered the 9th U.S. Circuit Court of Appeals to review its 7-4 ruling last year that upheld California’s law banning magazines that hold more than 10 bullets.
Known as a grant, vacate, and remand — The Justices often allow lower courts to review cases after a high court decision that could potentially change the outcome of a case.
The cases sent back Thursday include challenges to bans in New Jersey and California on high-capacity magazines that hold ten rounds or more, Maryland’s assault weapons ban, and Hawaii’s restrictions on open-carry. This may affect other states including Colorado, Oregon, and Washington state high capacity magazine bans.
