Meanwhile we are monitoring the following active lawsuits against Colorado Gun Control Laws:
1. Ghost Gun Ban Challenge
-
Gun rights groups — including Rocky Mountain Gun Owners and the National Association for Gun Rights — have filed a federal lawsuit opposing Colorado’s ban on “ghost guns” (homemade firearms without serial numbers), arguing it violates the Second Amendment.
2. Permit-to-Purchase Law (SB 25-003)
-
The Colorado State Shooting Association (CSSA), backed by the Mountain States Legal Foundation (MSLF), filed a federal challenge against the “permit-to-purchase” scheme requiring extensive training and permits for semiautomatic firearms with detachable magazines.
3. Firearm Tax Lawsuit
-
The Firearms Policy Coalition (FPC) filed a lawsuit to block a newly enacted firearms-related tax in Colorado, contending that it unconstitutionally targets gun owners.
4. Under-21 Purchase Age Law
-
A legal challenge regarding Colorado’s law raising the minimum age to purchase firearms from 18 to 21 continues in federal court. A 10th Circuit ruling allowed the law to remain in force during ongoing proceedings. While the case is active, it’s more of a continued battle than a new suit.
5. Club Q Red Flag Enforcement Lawsuits
-
Although not technically challenging gun control legislation, lawsuits were filed by victims of the 2022 Club Q shooting. They allege that local authorities failed to enforce Colorado’s red flag law, a key firearm safety statute.
