COURTS ARE BUSY: 7 Gun-Law Developments Colorado Owners Should Know About

The past two weeks have been unusually active for Second Amendment litigation.

Most notably, the U.S. Supreme Court unanimously ruled that the federal government cannot broadly prosecute otherwise law-abiding marijuana users for possessing firearms simply because they use marijuana. While the Court did not strike down the federal prohibition entirely, it significantly narrowed how the law may be applied and signaled continued scrutiny of firearm restrictions lacking historical support.

The Supreme Court also declined to hear a challenge to New York’s firearm-industry liability law, allowing lawsuits against manufacturers, wholesalers, and dealers to continue under that state’s public nuisance statute.

Meanwhile, courts continue to wrestle with the limits of the Second Amendment after Bruen and Rahimi. Washington’s Supreme Court recently upheld a law removing firearm rights from certain repeat DUI offenders, relying heavily on the concept that dangerous individuals may face firearm restrictions.

Closer to home, Colorado remains a major battleground. SB25-003 is still scheduled to take effect on August 1, 2026, while lawsuits challenging the permit, training, and certification requirements continue moving through the courts. Colorado residents should also keep an eye on ongoing federal litigation involving the state’s magazine restrictions and other firearm regulations.

Bottom line: The legal landscape is changing rapidly. Whether these cases expand or restrict gun rights, the courts—not the legislature—may end up making the biggest firearm headlines of 2026.’
