What’s Being Challenged – And Where It Stands

Ghost Gun Ban (SB23-279)

• Bans home-built firearms and unregistered parts kits.
• Status: Lawsuit filed by RMGO. Federal judge refused to block enforcement — law remains in effect.
• Next: RMGO is expected to appeal.

Age Restriction Law

• Raises firearm purchase age from 18 to 21.
• Status: A federal judge initially blocked the law, but the 10th Circuit reversed that decision.
• Law is now enforced while the lawsuit continues.3-Day Waiting Period (HB23-1219)
• Mandatory delay on all firearm purchases.
• Status: RMGO refiled their legal challenge. Law remains in effect pending outcome.

New Training Mandate for Semi-Auto Firearms (SB25-003)

• Requires background checks and state-certified safety training for most semi-automatic firearms starting August 2026.
• Status: Recently signed into law. No formal legal challenge filed yet, but it’s on the radar.6.5% Firearm and Ammunition Excise Tax (Proposition KK)
• Imposes a 6.5% tax on the retail sale of firearms, parts, and ammunition.
• Status: Lawsuit filed by NRA, Firearms Policy Coalition, Second Amendment Foundation, Colorado State Shooting Association, and Magnum Shooting Center.
• The lawsuit argues the tax infringes upon Second Amendment rights by imposing financial burdens on lawful purchases.

Bottom Line
Anti-gun laws are stacking up in Colorado. While several lawsuits are ongoing, courts have largely sided with the state — for now. Expect more legal action as new regulations approach their enforcement dates.
