CO Democrats Set to Pass Vague, Unenforceable Gun Ban Written by Non-Experts

After a marathon nine-hour hearing, a Colorado Senate committee narrowly voted 3-2 to advance a bill that would ban certain semi-automatic firearms—despite widespread opposition and serious constitutional concerns.The bill, which was not drafted by firearm experts, is so broadly written that it creates confusion over what weapons would actually be banned, making it nearly impossible to enforce.
Regardless of these issues, the bill is all but certain to pass, with 18 Democratic co-sponsors securing the necessary votes for approval on the Senate floor.
As expected, the committee vote followed strict party lines. Democrats on the committee, including Chair Sen. Michael Weissman, Sen. Tom Sullivan (the bill’s sponsor), and recently appointed Sen. Matt Ball, all voted in favor of the measure. Meanwhile, the two Republican senators, Rod Pelton and Byron Pelton, firmly opposed it, citing constitutional violations and concerns from law enforcement.
A Vague Bill That Could Ban Almost Any Semi-auto Firearm
One of the most alarming aspects of the bill is its broad and ambiguous language. It does not clearly define what constitutes a “specified semi-automatic firearm,” leaving open the possibility that many commonly owned guns could fall under the ban. The bill was not written by firearm experts, meaning that key technical details are missing, misleading, or overly vague—creating serious concerns about enforceability.
Sen. Tom Sullivan, the bill’s sponsor, has repeatedly cited personal tragedy as a reason to push this legislation forward. However, legislation that impacts constitutional rights must be carefully and precisely written. This bill fails to meet even the most basic standards for clarity and practicality.
Law Enforcement Warns: This Bill is Unenforceable
Republican Sen. Rod Pelton was among those who spoke out forcefully against the measure, calling it an outright attack on constitutional rights and warning that it is too vague to be realistically enforced.
“We heard from sheriffs. We heard from law enforcement today that this bill is flawed,” Pelton said. “We heard that it is viewed as unconstitutional, and I do share that view. I’m, at my core, a pro-Second Amendment individual, and I believe that ‘shall not be infringed’ means exactly that. This bill is an attack on our constitutional rights.”
Several law enforcement officials testified that the bill’s unclear definitions make it nearly impossible to enforce fairly. If passed, it could lead to confusion, wrongful arrests, and legal challenges that would cost taxpayers millions.
A Flawed Attempt at Gun Control That Ignores Reality
Large crowds gathered at the Colorado State Capitol in protest as lawmakers debated what is shaping up to be one of the most contentious bills of the legislative session.
Senate Bill 25-003 would impose sweeping restrictions on commonly owned firearms, banning the manufacture, distribution, transfer, sale, or purchase of many semi-automatic rifles, shotguns, and gas-operated handguns with detachable magazines.However, as critics have pointed out, criminals will continue to acquire weapons illegally—leaving only law-abiding citizens burdened by these new restrictions.
While supporters argue that the bill allows for certain legal transfers, such as to heirs or federally licensed dealers, opponents see it as yet another example of government overreach targeting responsible gun owners instead of violent criminals.
Colorado Democrats Have the Votes—But the Legal Fight is Coming
With 18 Democratic co-sponsors securing the votes needed for passage, the Colorado Senate is poised to approve this deeply flawed gun ban—ignoring constitutional protections, law enforcement concerns, and public opposition.
Tragic events should never be exploited to justify unconstitutional policies that punish responsible gun owners. The right to bear arms is a fundamental protection that ensures the preservation of freedom, security, and self-defense. While Sen. Sullivan’s loss is heartbreaking, it does not justify trampling on the rights of millions of Coloradans with a vague, unenforceable law.
Legal challenges are expected to follow, and Second Amendment advocates are prepared to fight. One thing is clear: Colorado’s gun owners will not accept this blatant infringement on their rights without a battle.
